The difference between a Judge and a Magistrate, generally speaking, is that a Judge is an elected official and a Magistrate is appointed by a Judge. A Magistrate is appointed by a Judge to handle a caseload similar to the Judge. A Magistrate presides over cases from start to finish including hearings and trials, and issuing Orders and Decisions. W. Scott Russell’s more than four (4) years of experience as a Magistrate provides him with an invaluable understanding of how Judges and other Magistrates evaluate cases,, the types of evidence that are most persuasive, and the legal nuances that can significantly impact the outcome of your case. Ohio is primarily a “no-fault” divorce state, meaning you can file for divorce based on incompatibility, without needing to prove wrongdoing. There are also fault-based grounds like adultery or extreme cruelty, but these are less common.

While not always mandatory, many Ohio courts encourage or require mediation before proceeding to trial, especially in custody and visitation disputes, to promote amicable resolutions.

Dissolution requires both parties to agree on all terms beforehand, resulting in a quicker, less adversarial process. Divorce is used when parties disagree and involves court hearings and potential litigation.

Ohio courts consider parents on equal ground. However, the courts can be persuaded by various factors including, but not limited to, the child’s relationship with each parent, each parents involvement with the child, the mental stability of each parent, the ability of each parent to provide adequately for the child, and the child’s wishes.

Ohio uses a standardized formula. This formula includes whether there is sole custody or shared parenting, the amount of parenting time of each parent, the number of children, who carries health insurance on the children and the cost of health insurance, whether there is daycare and who pays how much, and numerous other factors.
